1. Definitions
In these Terms and Conditions:
- "Nestora", "we", "us", "our" refers to the business operating under the name Nestora, based in George Town, Penang, Malaysia.
- "Programs" refers to the educational courses, workshop series, and comprehensive programs offered by Nestora, including the Planning Ahead Foundations Course, Life-Stage Savings Workshop Series, and Comprehensive Future Planning Program.
- "Content" refers to all materials, worksheets, modules, resources, and information made available through Nestora's programs and website.
- "User", "you", "your" refers to the individual accessing our website or enrolling in a Nestora program.
- "Agreement" refers to these Terms and Conditions together with our Privacy Policy.
2. Acceptance of Terms
By accessing our website, submitting an enquiry, or enrolling in a Nestora program, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you should not use our website or enrol in our programs.
You must be at least 18 years of age to enrol in any Nestora program. By enrolling, you confirm that you meet this requirement and have the legal capacity to enter into this agreement under Malaysian law.
3. Service Description
Nestora provides general educational programs on the topic of long-term savings planning. Our programs are designed to support learning and understanding of savings concepts at a general level. They do not constitute personalised financial advice, investment advice, or any regulated financial service under Malaysian law.
Programs are currently available to individuals in Malaysia, with facilitated sessions primarily based in George Town, Penang. Availability of online or hybrid sessions may vary and will be confirmed at the time of enrolment.
4. Enrolment and Program Access
Enrolment in a Nestora program requires completion of the enquiry process and payment of the applicable program fee. Access to program materials commences once enrolment is confirmed and payment has been received. For facilitated sessions, scheduling details will be communicated following enrolment confirmation.
Access to self-paced materials (Foundations Course) remains available for a period of 6 months from the start date. Access to the community forum (Comprehensive Program) is available for the duration of the 12-week program.
5. User Responsibilities
As a participant in Nestora programs, you agree to:
- Engage with program content in good faith and for personal educational purposes only
- Not share, reproduce, or distribute program materials (including worksheets, modules, and resources) without Nestora's prior written consent
- Treat fellow participants in facilitated sessions with respect and courtesy
- Not disrupt the learning environment for other participants
- Not use program access or community forum to promote financial products, services, or solicitations
6. Intellectual Property
All content, materials, worksheets, templates, and resources provided by Nestora remain the intellectual property of Nestora. Upon enrolment, you are granted a limited, personal, non-transferable, non-exclusive licence to access and use program materials for your own educational purposes only.
You may not reproduce, republish, sell, licence, or distribute any Nestora content without prior written permission. Unauthorised use may constitute an infringement of Nestora's intellectual property rights.
7. Payment Terms
Program fees are payable in Malaysian Ringgit (MYR) as listed:
- Planning Ahead Foundations Course: RM 540
- Life-Stage Savings Workshop Series: RM 1,590
- Comprehensive Future Planning Program: RM 3,020
Fees are payable in full at the time of enrolment. Payment methods will be communicated during the enrolment process.
Refund Policy: Cancellations made more than 7 days before a program's scheduled start date are eligible for a full refund. Cancellations within 7 days of the start date will receive a 50% refund. No refunds are available once program access has commenced, except in cases of a documented serious illness or emergency, which will be considered at Nestora's discretion.
8. Disclaimers
Nestora's programs are provided for general educational purposes only. All content is presented as general information about savings concepts and does not constitute personalised financial, legal, tax, or investment advice. Nestora is not a licensed financial planner, adviser, or regulated institution under the Securities Commission Malaysia or Bank Negara Malaysia.
Participants are encouraged to consult a licensed financial planner before making any financial decisions. Nestora does not make any representations about specific financial outcomes resulting from participating in its programs.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Nestora's total liability to you in connection with any program or use of our website shall not exceed the amount paid by you for the relevant program. Nestora shall not be liable for any indirect, consequential, incidental, or special damages arising from your participation in our programs or use of our website.
Nestora is not responsible for any decisions made by participants as a result of information learned in our programs. Participation does not create any advisory or fiduciary relationship between Nestora and the participant.
10. Indemnification
You agree to indemnify and hold harmless Nestora, its facilitators, and team members from any claims, losses, or damages (including legal costs) arising from your breach of these Terms, your misuse of our content or materials, or any activity in violation of these Terms carried out by you in connection with a Nestora program.
11. Termination
Nestora reserves the right to suspend or terminate your access to programs or program materials if you breach these Terms, including by sharing materials without authorisation or disrupting facilitated sessions. In cases of termination due to misconduct, no refund will be provided.
You may withdraw from a program at any time, subject to the refund policy set out in Section 7. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law shall survive termination.
12. Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from your use of Nestora's programs or website shall first be subject to an informal resolution process, where both parties will make reasonable efforts to resolve the matter directly within 30 days of the dispute being raised in writing.
If informal resolution is unsuccessful, disputes shall be subject to the jurisdiction of the courts of Penang, Malaysia. Nestora may also offer mediation through a mutually agreed mediator as an alternative to litigation.
13. General Provisions
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Nestora regarding your use of our programs and website.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full effect.
- Waiver: Failure by Nestora to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Assignment: Nestora may assign its rights under these Terms without notice. You may not assign your rights without Nestora's prior written consent.
- Notices: Notices to Nestora should be sent to the contact details listed in Section 15.
14. Changes to These Terms
Nestora may update these Terms and Conditions from time to time. The revised version will be posted on this page with an updated "Last Updated" date. Continued enrolment or use of our website after changes take effect constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify enrolled participants.
